 Mediation is a structured, interactive process where a trained, impartial third-party mediator assists two or more disputing parties negotiate to resolve the dispute through the use of specialized communication and negotiation techniques. Opposing parties are encouraged to actively participate in the process. Baker & Company's Supreme Court registered mediators utilize a variety of techniques to guide the process in a constructive direction and to assist the respective parties reach a settlement.

Our mediators are facilitative, they manage the communication between parties and help to facilitate open communication. Mediation is also evaluative, through our mediator’s analysis of the impending issue(s), they work closely with the opposing parties to assist with assessing their positions against relevant norms, while abstaining from providing prescriptive advice.
